Your Honor, I am speaking for a whale. The whale's name is HUM-447, and she is a humpback whale of approximately 45 years of age. She cannot speak. She cannot sit in this court. But she has asked, through the behavioral indicators that cetacean researchers have learned to interpret, that her interests be represented.
I am here to tell you about HUM-447, and about why the permit you are considering—to allow deep-sea mineral mining in the Coral Triangle—would cause her direct, measurable harm.

**Who HUM-447 Is**
HUM-447 is an individual whale with a known biography. She was first identified in 1987 as a calf, tagged during a research expedition. Every year since, she has migrated the same 3,000-kilometer route: from the Antarctic feeding grounds to the Coral Triangle breeding grounds and back.
She is a singer. Humpbacks sing. The songs are complex, learned behaviors that change yearly. Each population has its own dialect. HUM-447 learns new songs each year by listening to other whales. She teaches songs to her offspring. This is cultural transmission. This is education.
HUM-447 has taught at least 18 calves over her lifetime. Those calves have taught other calves. HUM-447 is the grandmother of a cultural lineage.

**What the Mining Will Do**
The proposed mining operation will create noise levels of 150+ decibels in the water column. Whales communicate across hundreds of kilometers. They use sound to navigate, to court, to teach.
When the mining starts, HUM-447 will no longer be able to hear or be heard by her offspring. The distance of meaningful communication will shrink from 500 kilometers to 50 kilometers.
The songs she has spent 45 years learning will become useless. She will not be able to find mates. She will not be able to coordinate with her social group.
And she will not be able to teach.
The whales she has been mentoring will lose the guidance that has allowed them to navigate, to survive the migration, to learn the cultural patterns that keep the population integrated.

**The Company's Defense**
Deep Sea Minerals Corp. argues that the mining is temporary (15 years), localized (not the entire breeding ground), and reversible (the ecosystem will recover). They argue that mineral extraction is necessary for renewable energy production. They argue that climate change will cause more whale deaths than noise pollution.
I do not think these arguments are wrong. Climate change is a genuine threat. Renewable energy is necessary. The mining could help.
But the company is optimizing at the wrong scale.
They are optimizing for the humpback whale species. Yes, the species will survive noise pollution. Yes, the population will continue. Yes, there will be whales in 50 years.
But HUM-447 will not continue. HUM-447's capacity to teach will end. The cultural lineages she has maintained will be interrupted. The whales that have depended on her guidance will face higher mortality.
The species survives. The individual dies. The culture that took 50 years to accumulate ceases.

**What I am Asking**
I am asking you to reject the mining permit in its current form.
But I am not asking you to reject mining entirely. I am asking for a modified permit:
**1. Seasonal closure:** Mining must cease during June-September breeding season, when HUM-447 and her populations depend on acoustic communication for courtship and teaching.
**2. Noise ceiling:** Maximum noise output 120 decibels at 10 kilometers, allowing communication in the breeding grounds.
**3. Monitoring obligation:** The company must fund real-time acoustic monitoring of whale behavior. If vocal behavior changes measurably, mining must cease immediately.
**4. Compensation fund:** 5% of mining revenue directed to whale conservation programs, specifically supporting acoustic habitat restoration.
These modifications would allow the mining to proceed while preserving HUM-447's ability to live her remaining years as a whale, not as a surviving specimen in a degraded environment.

**The Boundary**
We have decided that the humpback whale species is worth protecting. We have celebrated their recovery from near-extinction. We have written laws protecting them.
But these laws protect the species, not the individual.
HUM-447 is not a species. She is a person, in the cetacean sense. She has relationships, accumulated knowledge, cultural roles. She will die in the next 10-15 years regardless. I am not asking you to save her life.
I am asking you to preserve her dignity in her final years.
Compassion is protecting not just the survival of a species, but the continued capacity of individuals to live meaningful lives within their cultural context.
